In plain terms

  • We collect what an account needs to work: who you are, how to reach you, your location for matching, and what you do on the Platform.
  • A worker's phone number is never shown to employers.
  • We do not sell your personal information, and we do not share it for advertising.
  • Messages sent through the Platform are scanned by automated systems for scams and abuse, so they are not private from us.
  • We record which legal documents you accepted, when, and from what device, and we keep that as proof of agreement.
  • You can see, correct, or delete your data, and closing your account is available in settings.

This summary is here to be clear, not to replace anything. The numbered sections below are the agreement.

This Privacy Policy describes how Day Labor Work, a service owned and operated by Element Info Tech LLC ("Day Labor Work," "we," "us," or "our"), collects, uses, stores, and shares your personal information. The term "Platform" as used in this Privacy Policy refers collectively to the Day Labor Work website, the Day Labor Work iOS mobile application, the Day Labor Work Android mobile application, and any other websites, mobile applications, or digital products and services offered by Day Labor Work, whether currently available or released in the future. By using the Platform, you agree to this Privacy Policy.

SMS and Text Message Communications

Day Labor Work may send SMS text messages to the phone number associated with your account for the following purposes:

  • Two factor authentication and one-time verification codes for account registration
  • One-time passcodes for password resets
  • Job confirmation reminders
  • Account notifications, including security and account lockout alerts

Opt-In. By providing your mobile phone number during account registration at daylaborwork.com, or in the Day Labor Work mobile apps, you consent to receive SMS messages from Day Labor Work at that number for the purposes listed above. Before the form will submit you must also check a consent box agreeing to our Terms of Service, this Privacy Policy and our SMS Terms, where the full program description is published. You may turn off job and account text messages at any time under SMS Messages in your account settings, or by replying STOP.

Replies. Some messages ask you to reply. A job confirmation reminder asks you to reply to confirm that you will be at the job, and your reply is what tells the employer you are coming. Replying is optional, and a reply you send is a text message your carrier may charge you for at its normal rate.

Opt-Out. You may opt out of SMS messages at any time by replying STOP to any message we send. After opting out, you will receive one final confirmation message and no further SMS messages will be sent to your number.

Help. Reply HELP to any SMS message for assistance, email support@daylaborwork.com, or visit daylaborwork.com/contact for support.

Message Frequency. Message frequency varies. Day Labor Work does not send marketing or promotional SMS messages.

Message and Data Rates. Message and data rates may apply depending on your mobile carrier and plan. Day Labor Work is not responsible for any charges imposed by your carrier, and carriers are not liable for delayed or undelivered messages.

SMS messages are delivered by our messaging providers, currently Twilio for platform messages and Google Firebase for phone verification codes. Your phone number is shared with those providers solely to deliver the message and is not used for any other purpose. If we change providers, this policy is updated to name the new ones.

No Sharing of Mobile Opt-In Data. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as our SMS provider, is permitted solely to deliver the messages you requested. Text messaging originator opt-in data and consent will not be shared with any third parties.

1. Information We Collect

We collect information you provide directly and information generated through your use of the Platform.

Account Information

When you create an account, we collect your full name, phone number, email address, and password.

Profile Information

You may optionally provide additional profile information, including a profile photo or business logo, a bio or business description, your city, state, zip code, and mailing address. Employers may provide a business name, contact name, industry, years in business, and links to social media. Workers may provide skills, experience levels, work history, and availability.

Location Data

We collect city, state, and zip code information. We may also derive approximate geographic coordinates from that information for the purpose of matching workers with nearby job opportunities. The iPhone and Android apps may also ask your permission to use your device's location so the job feed can show what is near you. That is read while you are using the feature, and we do not track your device in the background. You can turn it off in your device settings, and the Platform falls back to the location saved on your profile.

Job and Application Data

Employers who post jobs provide job details including title, description, pay rate, required skills, and job location. Workers who apply for jobs provide application messages and any other information submitted through the application process. We store the status and history of all applications.

Resumes. A worker may add up to five resumes. We parse the file you upload, store the resulting text on your account, and do not keep the original file. A resume is visible to you, and to an employer only when you choose to attach it to an application.

Payment information. Employers who buy a plan or a promotion pay through our payment processor. We receive a record of the transaction, the plan, and the last four digits and brand of the card. We never see or store full card numbers.

Messages and Communications

When you use our built-in messaging system, the content of those messages is stored on our Platform. This includes messages sent in connection with job applications, job invitations, and general employer-worker communications.

Uploaded Files

You may upload photos to your profile or job postings. These files are stored on our Platform and may be visible to other users depending on your privacy settings.

Calendar and Availability Data

Workers may mark specific dates as unavailable on their profile calendar. This availability information may be visible to employers considering a job offer and is used to facilitate scheduling.

Payment and Subscription Data

If you purchase a subscription or job credits, your payment details are processed by a third-party payment processor that maintains Payment Card Industry Data Security Standard (PCI-DSS) compliance. We do not store your raw payment card numbers, CVV codes, or full payment credentials on our servers. We retain records of transactions, subscription tier, renewal dates, cancellation history, and purchase history.

Ratings, Reviews, and Endorsements

After a job is completed, employers and workers may be prompted to submit ratings and survey responses. Workers may also receive endorsements from employers. This information is stored and may be displayed on your public profile.

Log and Device Data

We automatically collect server log data and information about how you use the Platform, including pages visited, features used, actions taken, browser type, device type, operating system, referring URLs, and IP address. This data is used for security, debugging, and analytics purposes.

2. How We Use Your Information

We use the information we collect to:

  • Operate and improve the Platform
  • Connect workers with employers based on location, skills, and availability
  • Facilitate job applications, job invitations, and employer-worker communications
  • Process subscription payments and job credit purchases
  • Send transactional emails such as account verification, password resets, and job notifications
  • Display ratings, reviews, and endorsements on user profiles
  • Enforce our Terms of Service, detect fraud, and prevent abuse
  • Respond to support requests and user inquiries
  • Automatically expire or remove outdated job listings and inactive content
  • Generate anonymized, aggregated analytics to understand Platform usage
  • Comply with applicable laws and legal obligations

We do not sell your personal information to third parties.

3. How We Share Your Information

We do not sell your personal information. We share your information only in the following circumstances:

Between Workers and Employers

Using the Platform inherently involves sharing certain information between workers and employers. When a worker applies for a job, their profile, skills, and application message become visible to the posting employer. When an employer hires or invites a worker, the employer's contact information and job details become accessible to that worker. You acknowledge and consent to this sharing by using the Platform.

Service Providers

We share data with trusted third-party vendors who help us operate the Platform, as described in Section 7. These providers are contractually obligated to use your data only for the services they provide to us.

Legal Requirements

We may disclose your information when required by law, court order, subpoena, or government request, or when we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Day Labor Work, our users, or the public.

Business Transfers

If Day Labor Work is involved in a merger, acquisition, asset sale, reorganization, bankruptcy, or other transfer of business assets, your personal information may be transferred to the acquiring entity as part of that transaction. We will notify you via email or a prominent notice on the Platform before your information becomes subject to a materially different privacy policy.

With Your Consent

We may share your information in other ways if you have given us explicit consent to do so.

4. What Is Publicly Visible

Not all information you provide is visible to everyone. The following describes how visibility works on the Platform:

Job Listings

Job postings are publicly visible to all visitors, including unauthenticated users. This includes the job title, description, pay rate, general location, required skills, and employer name.

Employer Public Profiles

Employer business profiles, including business name, general location, industry, ratings, and badges, are publicly accessible. Employers can choose whether to display their phone number and email publicly.

Worker Profiles

Worker profiles, including name, skills, general location, ratings, and badges, may be visible to logged-in employers searching for workers. Workers can control whether their profile is discoverable and whether their email is displayed. A worker's phone number is never displayed, and that is not a setting a worker can turn on.

Contact Information

A worker's phone number is never shown to employers. It is collected only to verify the account and keep it secure, and it is not available through search, a profile, or a subscription of any kind. Employers and workers communicate through the Platform's messaging system. We do not display personal contact information to unauthenticated visitors.

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree not to share your login information with any third party. You are responsible for all activity that occurs under your account, whether or not you authorized it.

If you believe your account has been compromised or accessed without your authorization, you must notify us immediately by contacting us. We are not liable for any loss or damage arising from your failure to protect your account credentials or from your sharing of credentials with any other person.

6. Data Storage and Security

Your data is stored using industry-standard cloud infrastructure with encryption at rest and in transit. Access to data is restricted through role-based permissions and row-level security controls so that users can only access data they are authorized to see.

Security Disclaimer. While we take commercially reasonable steps to protect your personal information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee the absolute security of your data. By using the Platform, you acknowledge and accept this risk. We are not liable for unauthorized access to your data that results from circumstances beyond our reasonable control, including breaches of our third-party service providers, acts of hackers or malicious third parties, or your own failure to protect your credentials.

Technical Failures and Data Loss. We are not liable for any loss, corruption, or unavailability of your personal data resulting from technical failures, server errors, database malfunctions, software bugs, platform outages, or failures of third-party service providers used to operate the Platform. By using the Platform, you acknowledge that no technology is infallible and that data loss or temporary unavailability may occur despite our reasonable precautions. We encourage you to retain copies of any information you consider important that you submit through the Platform.

7. Third-Party Services

We use trusted third-party service providers to operate the Platform. These providers may process certain data on our behalf, including:

  • A cloud database, authentication, and file storage provider
  • A payment processor for handling subscription and credit purchases (we do not store your full payment card details)
  • A web font delivery service
  • A cloud hosting and content delivery provider

Each provider operates under its own privacy policy and data handling practices. We only share the minimum data necessary for each service to function. We are not responsible for the privacy practices or security of these third-party providers, and your use of the Platform constitutes your acknowledgment that data may be processed by such providers.

8. Third-Party Links

The Platform may contain links to external websites or services not operated by us. We have no control over the content or privacy practices of those sites and accept no responsibility for them. We encourage you to review the privacy policy of any third-party site you visit. The inclusion of a link does not imply endorsement.

9. Cookies and Tracking

We use cookies and similar technologies to maintain your session, remember your preferences, and improve the Platform experience. We do not use third-party advertising cookies or behavioral tracking for ad targeting. You may disable cookies in your browser settings, but some features of the Platform may not function properly as a result.

Do Not Track. Our Platform does not currently respond to browser Do Not Track (DNT) signals. We treat all users consistently regardless of DNT settings.

Global Privacy Control (GPC). Some browsers and browser extensions support the Global Privacy Control (GPC) signal, which users may activate to indicate a preference against the sale or sharing of personal information. We recognize and respect valid GPC signals as an opt-out request to the extent required by applicable state law, including California and Colorado. Because we do not sell personal information or engage in cross-context behavioral advertising, a GPC signal will not materially change how your data is processed on our Platform, but it will be logged and honored in accordance with applicable law.

10. Device, Log and Consent Records

Using the Platform generates technical records that we keep for security, fraud prevention, and proof of agreement.

  • Device and log data, including IP address, browser and device type, operating system, app version, timestamps, and pages or screens accessed.
  • The IP address and device you created your account from, and the IP address and device of your last ten sign-ins. We use these only to review whether an account is genuine, for example when abuse detection suspends an account and the account owner appeals. Older sign-ins are dropped automatically. Neither is ever shown to another user.
  • Push notification tokens from Apple or Google, so the apps can notify you about messages, offers, and jobs. Turning notifications off in your device settings stops this.
  • Consent records: which version of our Terms of Service, Privacy Policy, Worker Agreement, or Employer Agreement you accepted, when you accepted it, and the IP address and device used. Job specific confirmations made when you apply to a job or post one are recorded the same way, along with the job they belong to.
  • Records of safety flags raised by the screening described below, and the action taken on them.

Consent records exist so that both of us can prove what was agreed. We keep them for as long as your account exists and for as long afterward as the law allows, even if other account data is deleted, and they may be used as evidence in an arbitration or other proceeding.

11. Email Communications

We send transactional emails necessary to operate your account, including account verification, password resets, job notifications, and application updates. These emails are required for Platform functionality and cannot be opted out of while your account is active.

If we send any optional promotional or marketing communications, you will have the ability to opt out via an unsubscribe link in the email or through your account settings. Opting out of marketing emails will not affect delivery of transactional messages.

12. User-Generated Content and Content License

Content you submit to the Platform, including job postings, application messages, profile bios, photos, and reviews, is stored on our servers and may be visible to other users as described in Section 4. We reserve the right to remove content that violates our Terms of Service.

By uploading or submitting content to the Platform, you grant Day Labor Work a non-exclusive, worldwide, royalty-free license to store, display, and transmit that content solely for the purpose of operating and providing the Platform. This license ends when you delete the content or your account, subject to the data retention provisions in Section 14.

You represent and warrant that you have all rights necessary to grant this license and that your content does not violate the rights of any third party. You are solely responsible for the content you submit.

13. Sensitive Information

We do not intentionally collect sensitive categories of personal information such as health or medical data, biometric identifiers, financial account numbers, government-issued ID numbers, racial or ethnic origin, religious beliefs, or sexual orientation. Please do not submit this type of information through the Platform. If you do, you do so at your own risk, and we accept no liability for the collection, storage, or exposure of such data.

We specifically prohibit Employers from using the Platform or any job arranged through it to collect biometric information from Workers, including face scans, fingerprints, retina scans, voiceprints, or other biometric identifiers. If a job requires any form of biometric data collection from Workers, the Employer is solely responsible for complying with all applicable biometric privacy laws independently, including the Illinois Biometric Information Privacy Act (BIPA), 740 ILCS 14/1 et seq., where applicable. Day Labor Work shall not be liable for any biometric data collected by Employers at job sites or through any channel outside of the Platform.

14. Prohibited Use of Data

You may not use data obtained through the Platform, including contact information, profile details, or any other user data, for purposes outside of the Platform's intended use. Specifically, you may not:

  • Scrape, harvest, or systematically collect user data through automated means
  • Use contact information obtained through the Platform to send unsolicited communications
  • Compile, redistribute, or sell user data obtained from the Platform
  • Use data obtained from the Platform to build a competing product or service
  • Contact users outside of the Platform using information obtained through it, except for direct job-related communication

Violations may result in immediate account termination and may expose you to civil and criminal liability.

15. Safety and Abuse Prevention

We collect and use data to protect the safety of our community. This includes:

  • Records of reported jobs and reported users submitted through our reporting tools
  • Records of users blocked by employers
  • Automated systems to detect and prevent abuse of the Platform
  • Cooperation with law enforcement when required by applicable law or to prevent imminent harm

We may access message content and account activity to investigate reports of abuse, fraud, or violations of our Terms of Service. By using the Platform, you acknowledge that communications made through the Platform are not private from Day Labor Work for these purposes.

16. Automated Content Management

To keep the Platform accurate and relevant, we use automated processes to expire and remove outdated job listings, purge old conversations, and clean up inactive content. This is done without individual human review and is based on age and activity thresholds. We are not liable for any loss of data resulting from these automated processes.

17. Data Retention

We retain your account data for as long as your account is active. If you delete your account, we will remove your personally identifiable information within 30 days, except where retention is required by law or for legitimate purposes such as fraud prevention, dispute resolution, or enforcement of our Terms of Service. Aggregated or anonymized data may be retained indefinitely.

When we terminate an account for violations of our Terms of Service, we may retain certain records related to the violation for as long as necessary to prevent re-registration, protect other users, and support any legal proceedings.

18. Data Breach Notification

In the event of a data breach that affects your personal information, we will notify affected users as required by applicable state and federal law. Notification will be provided via the email address associated with your account. We are not liable for breaches that result from actions outside of our reasonable control, including breaches at third-party service providers, user negligence such as reusing passwords or sharing credentials, or criminal acts by third parties.

19. Your Rights

You have the right to access, correct, or delete your personal information at any time through your account settings. You may also request a copy of the data we hold about you by contacting us.

We will respond to verifiable data requests within the timeframes required by applicable law. We may deny requests that are excessive, repetitive, technically infeasible, or where fulfillment would require disclosing another person's information.

Note that deleting your account does not automatically remove all data associated with you. For example, job postings, messages, and reviews you have submitted may remain visible to other users or in our records in accordance with our data retention practices described in Section 16.

Right to Non-Discrimination. We will not discriminate against you for exercising any of your privacy rights. This means we will not deny you access to the Platform, charge you different prices or fees, provide you with a lower quality of service, or otherwise penalize you solely because you exercised a right described in this section.

Right to Data Portability. When you request a copy of your personal data, we will provide it in a structured, commonly used, and machine-readable format where technically feasible, so that you may transmit it to another service provider of your choice.

Response Timeframe. We will acknowledge your privacy rights request within 10 business days and will respond substantively within 45 days of receipt, with a possible 45-day extension if reasonably necessary, in which case we will notify you of the extension and the reason for it before the initial 45-day period expires.

Appeal Process. If we deny your privacy rights request in whole or in part, we will notify you in writing of the reason for the denial. You may appeal a denial by submitting a written appeal through our contact page within 30 days of receiving the denial notice. We will respond to your appeal within 60 days. If your appeal is denied, we will explain the reasons and, where applicable, provide information about any state privacy authority to which you may submit a complaint.

20. Children's Privacy

Day Labor Work is not intended for users under the age of 18. We do not knowingly collect personal information from minors. If we become aware that a minor has created an account, we will terminate it promptly and delete the associated data. If you believe a minor has provided us with personal information, contact us immediately.

21. No Employment Relationship

Day Labor Work is a marketplace platform and does not employ workers or act as a staffing agency. Nothing in this Privacy Policy or on the Platform creates an employment, contractor, agency, or joint venture relationship between Day Labor Work and any user. We are not responsible for any employment-related claims, disputes, tax obligations, or liabilities between workers and employers.

22. Indemnification

You agree to indemnify, defend, and hold harmless Day Labor Work and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) any content you submit, post, or transmit through the Platform; (c) your violation of this Privacy Policy or our Terms of Service; (d) your violation of any applicable law or regulation; or (e) your infringement of any third-party rights.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Day Labor Work and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the collection, use, storage, or disclosure of your personal information, including but not limited to unauthorized access to your data by third parties, loss of data, or data breaches at third-party providers.

Our total cumulative liability to you for any privacy-related claim shall not exceed the greater of (a) the amount you paid to Day Labor Work in the twelve months preceding the claim, or (b) one hundred dollars ($100).

24. Governing Law and Dispute Resolution

This Privacy Policy is governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. Any dispute arising out of or related to this Privacy Policy shall be resolved through binding individual arbitration in Jackson County, Missouri, in accordance with the dispute resolution provisions of our Terms of Service, which are incorporated herein by reference. You waive any right to participate in a class action lawsuit or class-wide arbitration related to any privacy claim.

25. International Users and U.S. Data Processing

The Platform is operated in the United States. All data collected through the Platform is processed and stored on servers located in the United States. If you access the Platform from outside the United States, your information will be transferred to and processed in the U.S., which may have different data protection laws than your country of residence.

The Platform is not directed at residents of the European Union, the European Economic Area, or the United Kingdom, and we do not represent that the Platform complies with the General Data Protection Regulation (GDPR) or equivalent laws. If you are a resident of those jurisdictions, do not use the Platform.

26. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via email or a notice on the Platform. The effective date at the top of this page will always reflect when the policy was last updated. Continued use of the Platform after changes are posted constitutes your acceptance of the updated policy.

27. State-Specific Privacy Rights

Depending on the state in which you reside, you may have additional privacy rights under applicable state law. Note that the Platform is not available in all states. Please review our Terms of Service for geographic restrictions before creating an account.

California Residents (CCPA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we have collected, the right to request deletion, and the right to opt out of the sale of personal information. We do not sell personal information. To exercise your CCPA rights, contact us. Note that the Platform's Terms of Service restrict use by California residents. By using the Platform, you represent that you are not a California resident or that you have reviewed and accepted those restrictions.

Other States

Residents of Virginia, Colorado, Connecticut, Texas, and other states with comprehensive consumer privacy laws may have similar rights to access, correct, delete, and port their personal data. To submit a request, contact us. We will respond as required by applicable law.

California and New York. The Platform is not available in California or New York, we do not operate or target users there, and accounts from either state are not accepted. If a resident of either state reaches the Platform anyway, that does not mean we do business there, and it is not consent to the jurisdiction of either state's courts. Any privacy right that applies to them by force of law still applies, and we honor it: we do not sell personal information, and a request to know, correct, or delete is handled the same way for everyone, wherever they are.

28. AI Screening of Listings and Messages

We use automated systems, including artificial intelligence, to scan content created on the Platform for scams, fraud, and abuse. This covers every job listing and every message sent between employers and workers through the Platform. Job listings posted from free employer accounts are screened automatically before or shortly after they go live.

Those systems look for things like:

  • Requests for a Social Security number, identity documents, bank or payment app details, or other personal information a job does not require.
  • Known scam patterns, including advance payments, overpayment and refund requests, gift card and cryptocurrency requests, check cashing, and package reshipping.
  • Attempts to move a conversation off the Platform quickly in order to avoid these protections.
  • Listings for remote or prohibited work, fake businesses, and impersonation.
  • Harassment, threats, discriminatory content, and requests for illegal or unsafe work.

When something is flagged, we may hold or block the message, remove or refuse the listing, warn or suspend the account, or escalate it for human review. A person on our team may read the flagged content in the course of that review, and we may keep a record of the flag and the action taken.

Two things follow from this. Messages sent through the Platform are not private from Day Labor Work, so do not send anything through them you would not want reviewed. And automated screening is imperfect: it can miss real harm and it can flag something harmless, so it is a safety measure rather than a guarantee, and it does not replace your own judgment about who you are dealing with.

We use this scanning to keep the Platform safe. We do not use the content of your messages to build advertising profiles or to sell to anyone.

29. Automated Decision-Making and Profiling

Day Labor Work uses automated systems to operate certain features of the Platform, including job matching suggestions, search ranking, and automated expiration of inactive content. These systems are designed to improve your experience.

We do not use automated decision-making that produces legal effects or similarly significant consequences affecting you without human oversight. We do not create behavioral profiles used to make automated employment decisions. The Platform's matching and search features are tools to help you find relevant opportunities or workers and do not constitute a binding determination or employment decision made by Day Labor Work.

If you have concerns about how an automated system has affected your experience on the Platform, you may contact us to request a human review.

30. Data Minimization and Purpose Limitation

We collect only the personal information reasonably necessary to operate the Platform and fulfill the purposes described in this Privacy Policy. We do not collect personal data speculatively or for undefined future uses.

Information collected for a specific purpose is not repurposed for an unrelated use without your consent or a legitimate legal basis. For example, contact information collected to facilitate job matching is not used for unrelated third-party marketing.

We periodically review the data we hold and delete or anonymize information that is no longer necessary for the purposes for which it was originally collected, subject to our legal retention obligations and the data retention practices described in Section 16.

31. Do Not Track and Global Privacy Control

We do not sell your personal information and we do not share it for cross context behavioral advertising, so there is nothing of that kind to opt out of. Where the law requires it, we honor an opt out preference signal such as Global Privacy Control sent by your browser. Browsers also send a Do Not Track signal that has no agreed meaning across the industry, and we do not respond to it separately, because we do not track you across other sites in the first place.

32. Service Providers We Rely On

Beyond the categories listed above, the Platform depends on providers for text messages used to verify a phone number, for push notifications delivered by Apple and Google, for transactional email, and for error and performance monitoring. Each receives only what it needs to perform that function, under its own privacy terms, and none of them receive your data to use for their own marketing.

Automated screening of listings and messages, described above, may involve a provider that processes content on our behalf for that purpose only. Content sent for screening is not used to advertise to you, and we do not sell it.

33. What You Share Directly with Another User

Anything you hand to another user is outside our control from that moment on. That includes what you type into a message, what you put on a public part of your profile, and anything you give an employer or a worker in person, by text, by email, or on paper.

We cannot take it back, we cannot make the other person delete it, and deleting your account does not remove it from wherever they kept it. To the fullest extent permitted by law, we are not responsible or liable for what another user does with information you gave them, including identity theft, fraud, or any criminal or malicious use of it. Our agreements tell you plainly not to share a Social Security number, an identity document, or bank details with someone who has not hired you, and that instruction is there for exactly this reason.

The same applies to anything visible publicly on the Platform. A public job listing or public profile can be seen, copied, screenshotted, or indexed by a search engine, and we cannot control or undo that.

34. Legal Holds and Records We Keep

When a dispute, claim, investigation, subpoena, or legal proceeding is reasonably anticipated or underway, we preserve the records that relate to it and hold them until the matter is resolved, even if you have asked for deletion in the meantime. A deletion request does not erase evidence.

Some records outlive an account by design: the consent records described above, which prove what was agreed and when, transaction and billing records we are required to keep, safety and abuse reports, and enough information to stop a removed account from simply registering again. We keep those for as long as the law allows, and we do not use them for anything other than the purpose that justified keeping them.

36. Language and Translations

This Privacy Policy is written and maintained in English, which is the official and controlling version. Any Spanish or other translated version is provided for your convenience on a best-effort basis and may be produced by automated tools. We do not guarantee that any translation is accurate, complete, or error-free. If there is any conflict or difference in meaning between the English version and a translated version, the English version governs and controls. To the fullest extent permitted by law, Day Labor Work and Element Info Tech LLC are not responsible or liable for any issue arising from a translation error or your reliance on a translated version.
